Senator Warren Makes a (Well-Intentioned) Category Error

Bless her, MA Senator Elizabeth Warren is right–we do need to appoint fewer corporate attorneys to the bench. But this strikes me as naive:

Sen. Elizabeth Warren (D-MA) on Thursday called on President Obama to nominate fewer judges who have represented corporate interests and more with backgrounds working for public interest groups…

“[I]t’s unsurprising that the president and a majority of the Senate gravitated to nominating corporate lawyers…that most conservative senators could not object to,” she said. “We have an opportunity to…fight for something that balances the playing field in the other direction.”

What makes Warren think Obama will change? He got his big political boost from real estate developers. His education reforms dovetail nicely with for-profit education (which is tied to those same real estate developers). His policies overall have been Rockefeller Republican. He unilaterally decided not to enact a living wage for federal employees and contractors.

I would love to proven wrong, but there is nothing to date that suggests Obama’s nominee’s are a bug, not a feature.
